Welcome to HappyBeing.io Counselling & Coaching Services. By engaging with our services, you agree to the following terms and conditions, designed to ensure professional standards, confidentiality and mutual respect in all interactions.


1. Scope of Service

HappyBeing offers mental health and emotional wellness counselling, relationship guidance and coaching, including but not limited to:

  • Personal and group coaching, counselling and guidance for managing marital issues, stress, anxiety, emotional health and behavioural change.
  • Workshops, webinars and programs conducted by trained experts.
  • Self-help resources, including assessments, techniques, interventions and educational content.

Professional Standards
All services provided are in line with proven research recommended by wellbeing coaches and psychologists. Psychological intervention provided by our in-house therapists and consultant therapists complies with the ethical principles set by the American Psychological Association (APA). Our professionals uphold values of integrity, respect and responsibility in every client interaction.

Service Limitations

  • HappyBeing’s services are not a replacement for clinical therapy, diagnosis, psychiatric intervention or medical treatment. Our professionals are certified to provide non-clinical support and lifestyle guidance.
  • Any recommendations or strategies suggested are intended to transform relationships and promote wellbeing and happiness.
  • As wellness service providers, we do not and cannot guarantee delivery of the desired outcome, since outcomes are multifactorial and cannot be solely controlled by us. We will not be held liable for not achieving desired results.

2. Privacy, Confidentiality & Data Protection

Privacy and Confidentiality
HappyBeing is committed to protecting your privacy and maintaining the confidentiality of personal information shared with us during counselling sessions, coaching sessions, assessments, workshops, programs, use of our website or any communication with us through phone, WhatsApp, SMS, email or other digital channels.

Your trust forms the foundation of our services. We recognise the sensitive nature of counselling, coaching, relationship guidance, emotional wellbeing and personal growth conversations. Therefore, we follow privacy-first principles and take reasonable steps to ensure that your personal data is handled responsibly, transparently and securely.

We do not sell, rent or trade your personal information to any third party.

This section explains how HappyBeing collects, uses, stores, shares and protects personal data when you access or use our website, services, sessions, workshops, programs or any other communication channel associated with HappyBeing, in accordance with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000 and applicable Indian laws.

This Privacy, Confidentiality & Data Protection section must be read together with these Terms & Conditions. By using our services, you acknowledge that you have read, understood and agreed to the terms contained in this section.

Information We Collect
When you enquire (online or offline), register, book a session, attend a session, participate in a program, complete an assessment or communicate with HappyBeing, we may collect certain personal details that you voluntarily provide.

This may include your name, age, gender, location, contact details such as your mobile number or email address, session preferences, relationship or wellbeing concerns, assessment responses and any other information you choose to share with us.

This information is collected only to enable communication, session scheduling, service delivery, expert matching, assessment, intervention planning and the effective functioning of our services.

Session-Related Information
HappyBeing does not record or keep session data in digital formats such as audio or video, unless explicit consent is obtained for a specific purpose.

Most of the information shared during sessions may be documented as handwritten notes by the concerned counsellor, psychologist, therapist or coach. These notes may be retained for a maximum period of three months starting from the end of sessions, unless a longer retention period is required by law, professional obligation or specific client consent.

For operational and service improvement purposes, HappyBeing may collect limited session-related information such as session date, duration, frequency, attendance status, payment status and service category. This information is used strictly for scheduling, billing, internal administration, service improvement and compliance purposes.

Any future recording, analysis or use of session content for training, supervision, service enhancement or quality improvement will be done only after obtaining explicit and informed consent from the client, in accordance with applicable laws.

Technical and Usage Information
When you use our website or digital platforms, we may automatically collect certain technical information such as IP address, device type, browser details, website usage patterns, cookies and similar technical data.

This information is used for website security, fraud prevention, analytics, system administration, improving user experience and ensuring the smooth functioning of our platform.

How We Use Your Personal Data
HappyBeing uses personal data only for legitimate, specified and lawful purposes. Your data may be used to:

  • Respond to your enquiries.
  • Schedule, manage and deliver counselling, coaching, workshops, programs, assessments or other services.
  • Connect you with an appropriate counsellor, psychologist, therapist, coach or expert.
  • Understand your concerns and support intervention planning.
  • Communicate with you through phone, WhatsApp, SMS, email or other agreed channels.
  • Manage payments, invoices, session records and administrative requirements.
  • Improve our services, website experience, internal processes and client support.
  • Comply with legal, regulatory, professional or ethical obligations.

We collect and process only such personal data as is reasonably necessary for providing our services and ensuring the effective functioning of HappyBeing.

Legal Basis for Processing
HappyBeing processes your personal data based on your consent, your voluntary engagement with our services and legitimate uses permitted under applicable laws, including the provision of services, compliance with legal obligations, protection of client safety and fulfilment of professional and ethical responsibilities.

You may withdraw your consent for future processing of your personal data, subject to legal, contractual, ethical or service-related limitations.

Confidentiality of Sessions and Limited Exceptions
HappyBeing maintains confidentiality over all information shared during counselling, coaching, therapy, assessment and wellbeing-related interactions.

Information shared by clients will not be disclosed to third parties without explicit consent, except in limited and legally justified circumstances.

Confidentiality may be breached where:

  • There is a clear and imminent risk of harm to the client.
  • There is a clear and imminent risk of harm to another person.
  • There is suspected child abuse, elder abuse, abuse, neglect or violence requiring action under applicable law.
  • Disclosure is required by a valid court order, lawful directive or government authority.
  • Disclosure is necessary to comply with legal, regulatory, professional or ethical obligations.

In situations involving suicidal thoughts, self-harm, domestic violence, abuse or threats, HappyBeing may take necessary steps to support safety, including encouraging the client to contact emergency services, informing appropriate support contacts where necessary or complying with applicable legal obligations.

Cookies and Tracking Technologies
HappyBeing may use cookies and similar technologies to ensure the smooth functioning of the website and to enhance user experience.

Cookies may help us maintain secure sessions, remember user preferences, understand website usage and analyse website performance.

You may control or disable cookies through your browser settings. However, disabling cookies may affect certain features or functionality of the website.

Data Security Measures
HappyBeing employs reasonable and appropriate technical and organisational safeguards to protect personal data from unauthorised access, disclosure, alteration, misuse, loss or destruction.

These measures may include secure communication systems, restricted access controls, confidentiality obligations, secure servers and other reasonable security practices.

While HappyBeing takes reasonable steps to protect your information, you understand that no method of transmission over the internet, phone, email, WhatsApp, SMS, video call or other digital communication channel is completely secure or impenetrable.

By using our services or communicating with us digitally, you accept the inherent risks associated with digital communication.

Data Retention
HappyBeing retains personal data only for as long as necessary to fulfil the purposes for which it was collected, provide services, meet legal or regulatory obligations, resolve disputes, maintain records or comply with professional and ethical requirements.

Session-related handwritten notes may be retained for a maximum period of three months starting from the end of sessions, unless a longer retention period is required by law, professional obligation, safety concern, dispute resolution or specific client consent.

Once personal data is no longer required, HappyBeing may securely delete, destroy, anonymise or archive the data in accordance with applicable laws and internal policies.

Sharing and Disclosure of Personal Data
HappyBeing may share personal data only when necessary and in limited circumstances.
This may include sharing data with:

  • Counsellors, psychologists, therapists, coaches, experts or internal team members involved in providing services.
  • Trusted third-party service providers who assist in operating the website, communication systems, payment systems, scheduling tools or administrative processes.
  • Legal, regulatory, government or judicial authorities where required by law.
  • Emergency contacts, support persons or appropriate authorities where there is a serious and imminent risk to safety, subject to applicable laws and ethical obligations.

Any sharing of personal data will be carried out in accordance with applicable laws and reasonable confidentiality and data protection obligations.

Your Rights Over Your Personal Data
You may have the following rights in relation to the personal data shared by you with HappyBeing, subject to applicable laws:

  • Right to Withdraw Consent: You may request withdrawal of consent given to HappyBeing for future processing of your personal data.
  • Right to Access: You may request a summary of your personal data processed by HappyBeing and the manner in which such data is processed, subject to verification of your identity and applicable legal limitations.
  • Right to Correction and Erasure: You may request correction of inaccurate or misleading personal data, completion of incomplete personal data, updating of personal data or erasure of personal data, subject to legal, contractual, professional, ethical or service-related requirements.
  • Right to Grievance Redressal: You have the right to raise a grievance regarding the handling of your personal data or the exercise of your rights.
  • Right to Nominate: You may have the right to nominate another individual who may exercise your rights on your behalf in the event of your death or incapacity, subject to applicable laws.

HappyBeing may require valid proof of identity before processing any request relating to your personal data.

HappyBeing reserves the right to update or modify this Privacy, Confidentiality & Data Protection section and terms from time to time. Any material changes may be communicated through the website, platform or other appropriate means.
Continued use of HappyBeing’s services after any updates indicates acceptance of the revised terms.


3. Emergency and Crisis Protocol

Crisis Communication
In situations involving suicidal thoughts, domestic violence or threats, please contact the emergency services provided above, as our organization is not equipped to provide immediate crisis intervention. You are also encouraged to contact your loved ones or the contacts you have provided to the organization as your support.

HappyBeing may attempt to assist by providing resources but is not liable for outcomes related to emergency situations.

Emergency and Crisis Protocol
Our services do not include crisis intervention or emergency care. In the event of an emergency, clients are advised to seek immediate assistance by calling emergency services or going to the nearest hospital. In case of any emergency situations, please contact the following helplines:

  • 112 is the national emergency number for India. Call 112.
  • 1091 - Women Helpline for domestic violence, National Commission for Women (NCW).
  • 1098 - Children Helpline.
  • Vandrevala Foundation (www.vandrevalafoundation.com): +91 9999666555, a 24/7 helpline. It is a call and WhatsApp-based service. Provides free crisis intervention.
  • Muktaa Mental Health Helpline (www.muktaamentalhealth.com): 788-78-9882, 12:00 pm - 8:00 pm, Monday to Saturday. Suicidal thoughts, uncontrollable anger, relationship issues, sexual concerns, family and relatives, peers and friendships, academics and career, sadness and depression, gender and sexuality and anxiety and stress.
  • AASRA (http://www.aasra.info/): +91-22-27546669 is a 24-hours-a-day, 7-days-a-week nationwide voluntary, professional and confidential service.
  • 1Life (https://1life.org.in/): +91 78930 78930, a 24/7 helpline for suicide prevention and crisis support.
  • Sneha India (http://www.snehaindia.org) is available 24/7 on the phone by calling +91 44 2464 0060. Suicide, depression, anxiety, sexual abuse and domestic violence.
  • iCall (https://icallhelpline.org/): Monday to Saturday from 10:00 am - 8:00 pm. It is a telephone and email-based counselling service run by the School of Human Ecology, Tata Institute of Social Sciences, that offers free telephone and email-based counselling services.

4. Unbiased and Non-Judgmental Support

HappyBeing is committed to providing a respectful, inclusive and unbiased environment. Our counsellors and coaches are trained to offer a non-judgmental space where all clients can freely express their concerns and perspectives. Our professionals strive to approach each session with sensitivity, awareness and inclusivity, ensuring that all services are free from discrimination and considerate of diverse perspectives.


5. Fees, Payment, Cancellation & Refund

Payment Terms
Fees and payment terms are established at the onset of services and documented in the service agreement. Payment must be completed as per the agreed terms. Session fee needs to be paid in advance to book a session. Session fee will increase with the rise in cost to provide services and clients will be informed in advance about the same. The new fee slab will be applicable for ongoing clients and new clients and they have the discretion to continue or discontinue their sessions.
We strive to keep a standard flat session fee for all our clients.

Cancellation & Rescheduling Policy

  • Clients may request cancellation or rescheduling of a booked session by informing HappyBeing at least 24 hours before the scheduled session time.
  • A session may be rescheduled once, subject to the availability of the assigned counsellor, psychologist, therapist, coach or expert. Any further rescheduling request may be accepted at the discretion of HappyBeing.
  • If a client cancels or requests rescheduling less than 24 hours before the scheduled session time, HappyBeing reserves the right to treat the session as consumed and the session fee may not be refunded.
  • If a client does not attend the scheduled session without prior intimation, the session will be treated as a no-show. In such cases, the session will be considered consumed and no refund or rescheduling will be applicable.
  • If a client joins the session late, the session will still end at the originally scheduled time, unless otherwise agreed by the concerned counsellor, psychologist, therapist, coach or expert.
  • In case of genuine emergencies, HappyBeing may, at its sole discretion, allow rescheduling of the session. Such rescheduling will be subject to availability and will not create an automatic right to refund or repeated rescheduling.
  • If any refund is approved by HappyBeing, the refund will be processed to the original payment method within 7–10 working days, subject to banking and payment gateway timelines.

Non-Payment
If payment obligations are not met, we reserve the right to discontinue services. However, no records will be withheld that are needed for emergency treatment.

Fee Refund
All clients are entitled to a no-questions-asked refund only after and for the 1st session. No refunds will be applicable after the 2nd session onwards if a client chooses to continue with sessions.


6. Rights and Responsibilities

Client Rights
Clients have the right to be treated with dignity and respect and to receive services without discrimination. Clients may request clarification regarding services at any time.

Client Responsibilities
Clients are expected to actively participate in their therapeutic journey and provide accurate information to the best of their ability, including all past and present medical history, for the planning of future interventions.

Responsibility for Claims
You agree to take responsibility for and protect HappyBeing against any claims, liabilities, damages or costs that may arise from your use of our services, a breach of these Terms or actions that go against applicable laws.

Modifications to Terms and Conditions
We reserve the right to modify these terms at any time, with updated versions accessible on our website. Continued engagement with our services following modifications indicates acceptance of the updated terms.


7. Terms and Conditions for Clients Working with a Counselling Psychologist

By engaging with a counselling psychologist at HappyBeing, clients agree to the following terms:

  • Role and Scope of Counselling: Counselling at HappyBeing is provided by qualified professionals who offer psychological support and therapy for mental health concerns. Counselling is not a substitute for medical treatment and does not provide emergency care.
  • Confidentiality: Sessions are confidential and protected by privacy laws. Information shared during therapy will not be disclosed without the client’s consent, except in cases of imminent risk to the client or others, as required by law.
  • Therapeutic Boundaries: Clients acknowledge that the therapeutic relationship is professional and structured. The counselling psychologist will maintain ethical boundaries to ensure a safe and effective therapy environment.
  • Responsibility and Participation: Therapy is a collaborative process. Clients are encouraged to actively participate in sessions and follow through on agreed actions between sessions for optimal therapeutic outcomes. Therapists will not be held liable or responsible for achieving or not achieving desired results by the clients.
  • Emergency Protocols: In cases where clients express thoughts of self-harm, harm to others or other crisis situations, the counsellor may be required to intervene according to professional ethical standards and legal obligations.
  • Termination and Referral: Counselling may end by mutual agreement when goals have been met or if the psychologist determines a referral to a specialist is in the client’s best interest.
  • Nature of Therapy: Clients are provided with clear information regarding the purpose, to benefit the client through the goals decided mutually in the beginning of the session.
  • Duration: Depending on the issue and gravity of the client’s concern, it is divided into three phases: initially case history taking, understanding the concern, working through the treatment plan and lastly equipping the client with a toolkit to prevent relapse and termination of therapy.
  • Termination of Therapy: Therapy may be terminated:
    1. When the goals are achieved as mutually decided by the therapist and client.
    2. When the client’s needs are beyond the expertise of the therapist or if there is a lack of engagement in therapy.
    3. Failure to adhere to these guidelines may result in the suspension or termination of services by either party with or without any explanation.
    4. Disruptive, inappropriate or abusive behaviour.
    5. Attempting to pressure counsellors or coaches to provide diagnoses, prescriptions or services beyond the scope of mental health coaching.
    6. Engaging in inappropriate communication with staff or other clients.
  • Voluntary Participation: Participation in therapy or any service is entirely voluntary and clients may withdraw from therapy at any time, with an understanding of any associated consequences.
  • Dual Relationships: To maintain objectivity and avoid conflicts of interest, our professionals avoid relationships outside the therapeutic context with clients, including personal, financial or social interactions.
  • User Conduct: Users agree to respect the professional boundaries established during sessions.

8. Informed Consent

We work with and consider the information provided by the client as a reliable source of information. Through informed consent, the client provides permission to the therapists, coaches and experts to devise an intervention plan as mutually decided during therapy and adhere to it. It also encourages open communication regarding any concerns or expectations.


9. Ethical Compliance

Adherence to Ethics
Our therapists abide by the APA’s Code of Conduct, which outlines strict guidelines against any exploitative, misleading or harmful behaviors. This includes non-involvement in relationships that could impair professional judgment.


10. Terms and Conditions for Clients Working with a Coach

The term “coaching” as used here covers life coaching, personal coaching, personal development, marital coaching, executive coaching and business coaching for clients and, where applicable, includes mentoring or supervision services provided for clients, coaches or others. Coaches are not psychologists or mental health practitioners and their coaching cannot be considered psychological therapy or equivalent to that.

In the spirit of good practice, when you are purchasing coaching services from us, we understand that you have read and agreed to each statement below and that you wish to proceed.


11. Coaching Disclaimer

By engaging with a coach at HappyBeing, clients agree to the following terms:

Role and Scope of Coaching
Clients understand that coaching is a collaborative, client-centered process focused on self-improvement, goal-setting and personal development. Clients understand that the coaching services provided by the coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. Clients also understand that the coach is not acting as a mental health counsellor or a medical professional.
You understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and you will not use it in place of any form of therapy.

Legal Purposes
Clients understand that coaching is currently an unregulated industry and that your coach is not “licensed” by any authorized body to provide certifications or proof regarding information provided by you in the sessions.

Accountability
Clients are responsible for implementing strategies, wellbeing, making decisions and pursuing goals discussed during coaching sessions. While coaches provide guidance, clients remain accountable for their personal growth and outcomes.

Confidentiality
All coaching sessions are confidential and information shared will not be disclosed without the client’s written and verbal consent, except as required by law.

Termination
Either the client or the coach may terminate the coaching relationship at any time if it is determined that coaching is not serving the client’s best interests.

Professional Boundaries
Clients understand that coaching is a professional relationship. Coaches will maintain appropriate boundaries and operate within their professional code of conduct.

Responsibility and Liability
Clients understand that all comments and ideas offered by your coach are solely for the purpose of aiding you in achieving the defined goals you create with your coach. You have the ability to give your informed consent and hereby give such consent to your coach to assist you in achieving such goals and understand that results are not guaranteed.
The client is liable to provide the best and honest information to coaches for goal setting and a better transformation journey.
Clients understand that to the extent our work together involves personal development, career or business, your coach is not promising outcomes, including but not limited to personal introspection, increased personal happiness, career progression, profitability and/or business success.

Waiver
You hereby release, waive, acquit and forever discharge your coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit, action, demand or right to compensation for damages you may claim to have or that you may have arising out of acts or omissions by yourself or by your coach as a result of the advice given by your coach or otherwise resulting from the coaching relationship contemplated by this agreement.
You further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to you to sign this agreement. This agreement shall bind your heirs, executors, personal representatives, successors, assigns and agents.


12. Coaching Schedule, Fees & Responsibilities

Terms & Conditions
The coaching schedule will be arranged between the coach and the client and can be booked up to 2 weeks in advance.
Our coach will recommend the frequency of coaching sessions based on a professional assessment of the client’s requirements. This recommendation or plan, is not binding and may be altered and adjusted throughout the coaching journey by mutual agreement, in accordance with the terms set out in this agreement.

Fees & Payment Terms

Therapeutic Boundaries
Clients acknowledge that the therapeutic relationship is professional and structured. The counselling psychologist will maintain ethical boundaries to ensure a safe and effective therapy environment.

Fee Refund
All clients are entitled to a no-questions-asked refund only after and for the 1st session. No refunds will be applicable after the 2nd session onwards if a client chooses to continue with sessions.

Responsibilities
The coach will seek to enable the client to improve their quality of life or level of business success and to achieve their desired outcomes. Remarkable results can be achieved where clients follow a clear plan in a committed way. However, the client has sole responsibility for taking important decisions in their life or business.
The coach has no liability for any loss incurred by any client, whether financial or otherwise, following the commencement of coaching sessions or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in trauma recovery, quality of life, career or business or to achieve their desired outcomes or goals.
